THE APPEAL ISSUES-READ ALL ABOUT

| The BGH
Bulletin has always had the ultimate respect for the ability
of the news consumer to read and understand information for
him/herself. In
that spirit, we would like to make available here the actual
court documents filed in the appeal of our court victory
through links in this article.
A
little clarification here for those of you not used to
maneuvering your way through the court system. The Second District
Court of Appeal (DCA) is the next level up from Circuit Court,
where our jury trial was held. The three-judge panel that
hears appeals is randomly assigned. The decision could take a
few days or it could be close to a year before we hear the
result.
Just
for backgroundFox Television is appealing my whistleblower
verdict from August 2000. Since the verdict, we
have not seen a dime of our $425,000 award.
The
panel could decide to let the jury verdict stand. Statistically, the
vast majority of cases are left alone because it is considered
bad form to overturn the work of jurors. The panel could decide
to remand the case for re-trial, or they could decide to
reverse the jury verdict. In that case, the panel
would essentially be saying that the jury verdict was so wrong
there is no reason to send it back to trial.
